Privacy Policy

The PepsiCo Canada Foundation (the “Foundation”) has adopted this Privacy Policy to show its firm commitment to preserving the confidentiality of personal information. This Policy applies to privacy practices at www.ThePepsiCoCanadaFoundation.ca, or www.LaFondationPepsiCoCanada.ca, and all related event websites (the “Website”).
Collection and Use of Personal Information
The Foundation only accepts personal information from individuals who are of the age of majority in their province or territory of residence. By providing personal information, you confirm that you are of the age of majority.

The Foundation collects personal information in the following circumstances:
a. Purchase of Store Items
When you purchase a product through the Websites, we collect your name, payment card information, billing address and email, and we use this information to process your payment and administer your order. We may also use this information to provide you with communications relating to the Foundation golf tournament.
b. Registration for Foundation Event
When you register for an event sponsored by the Foundation, we request the name and email address of each person attending the event, and we ask you to create a group name and access code. We also request your payment card information to process and administer your payment. We may also use this information to provide you with communications relating to the Foundation event.
c. Donations
When you make a donation to the Foundation via the Websites, we collect your name and payment card information, billing address and email in order to process and administer your donation. We may also use this information to provide you with communications relating to the Foundation golf tournament.
d. Contact Us
When you contact us with a question, comment or complaint, we may ask you for information that identifies you (such as your name, address and a phone number) along with additional information we need to help us promptly answer your question or respond to your comment or complaint.
Disclosure of Personal Information
The Foundation will not disclose, trade, rent, sell or otherwise transfer your personal information, without your prior consent, except as otherwise set out in this Policy or as required or permitted by law.
Service Provider Arrangements
Our affiliates, authorized agents and other third parties may provide services on our behalf (for example, authorizing / processing payments, hosting our Websites, operating certain features of the Websites). We may transfer or otherwise make available your personal information to these service providers, but they are required to keep the information confidential and to use it only for the purposes covered by your consent to the Foundation. Your personal information may be stored and processed outside of Canada.
Legal
The Foundation and its service providers may be obligated to provide your personal information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required by applicable law. We may also disclose personal information to assist us in collecting a debt owed by you, or otherwise where necessary for the establishment, exercise or defence of legal claims.
Retention of Personal Information
The Foundation will keep personal information for a reasonable period of time in order to fulfill the identified purposes, or as required or permitted by law or business custom, following which we will render your information anonymous or destroy it in a manner that will help to protect it against unauthorized access or disclosure.

a. Security
The Foundation maintains reasonable administrative, technical and physical safeguards in an effort to protect against unauthorized access, use, disclosure and modification of personal information in our custody or control.
b. Automated Data Collection
In general, you can visit our Websites without telling us who you are or submitting any personal information. We may collect information about you such as the type of internet browser or computer operating system you are using and the domain name of the website from which you linked to our site. In addition, when you view our Websites, we may store some information on your computer in the form of a "cookie" or similar file. Cookies allow us to tailor a website or promotion to better match your interests and preferences. Most internet browsers enable you to erase cookies from your computer hard drive, block all cookies, or receive a warning before a cookie is stored. The Foundation does not collect your personal information automatically, but we may tie the information that we do collect automatically (such as the type of internet browser that you use) to your previously submitted personal information.
Access to your Personal Information
Subject to certain exceptions prescribed by law, you have the right to access, update, correct inaccuracies in, or request deletion of, your personal information in our custody and control. You may do so by emailing or writing to us at the contact information set out below, but we reserve the right to request certain personal information for the purposes of verifying your identity.

While our response will ordinarily be provided at no cost to you, depending on the nature of the request and the amount of information involved, we reserve the right to charge a fee. In these circumstances, we will inform you of the approximate cost to provide the response and proceed upon receipt of your confirmation that you wish us to continue and that you will pay the estimated charge at the time of or before receiving access to the information.
Changes to the Privacy Policy
This Privacy Policy may be updated periodically to reflect changes to our personal information practices. The revised Privacy Policy will be posted on the Websites.
